   An act to add Section 1198.7 to the Labor Code, relating to
education.



	LEGISLATIVE COUNSEL'S DIGEST


   AB 344, Knox.  Education:  academic personnel files.
   Existing law requires employers to make employee personnel files
available for inspection by employees, as specified.
   This bill would authorize an institution of higher education to
provide academic employees access to academic peer review records in
a form that does not reveal the identity of any reviewer.  The bill
would exempt material that is part of an academic performance
evaluation of an academic employee of an institution of higher
education from a requirement that employers remove specified adverse
material from an employee's personnel file.  These provisions would
only become operative if SB 172 is chaptered and becomes operative on
or before January 1, 2000.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:


  SECTION 1.  Section 1198.7 is added to the Labor Code, to read:
   1198.7.  (a) Notwithstanding Section 1198.5, an institution of
higher education may provide an academic employee with access to
academic peer review records in a form that does not reveal the
identity of any of the reviewers.
   (b) Subdivision (h) of Section 1198.5 does not apply to material
that is part of an academic performance evaluation of an academic
employee of an institution of higher education.
  SEC. 2.  Section 1 of this act shall become operative only if
Senate Bill 172 of the 1999-2000 Regular Session is chaptered and
becomes operative on or before January 1, 2000.
